User Agreement
Effective Date: 05.25.2021
Henceforth, Kahne Screen Print, LLC and its parents, subsidiaries, owners, employees, agents, representatives, and vendors shall be referred to as “Administrators” of www.kahnescreenprint.com (hereinafter referred to as the “Service”). By using the Service, you (hereinafter the “User”) agree to the terms and conditions concerning the standard of use relating to the Service contained herein (hereinafter the “Agreement”). We reserve the right to modify, alter, or update the terms and conditions of this Agreement at any time, without prior notice. Such modifications become effective immediately upon being uploaded to the Service. If the User does not agree with the terms and conditions outlined in this Agreement, immediately cease all usage of the Service.
I. Registration and Use Restrictions
Pursuant to the Children’s Online Privacy Protection Act, the Service is only to be used by individuals at least thirteen (13) years of age. Minors below the age of thirteen (13) are not permitted to register for an account.
Users agree that when electing to use the Service, they will (a) provide accurate and complete information about themselves in areas where that is required and applicable and (b) update information so as to ensure it is current and complete.
When registering for an account, Users must create a password to ensure their account is protected. Users agree to keep this password confidential, and to immediately notify Administrators in the case of unauthorized use of their account.
II. Intellectual Property Rights and Content Restrictions
All digital materials, including but not limited to, (i) images, (ii) designs, (iii) photographs, (iv) illustrations, and (v) other forms of media, whether tangible or intangible, print, or digital, publicly posted or privately transmitted to Kahne Screen Print, LLC, are subject to vetting. Administrators reserve the right to reject design proposals that are hateful, libelous, indecent, or otherwise objectionable. Users are not permitted to submit design material that violates any proprietary rights of a third party. By submitting design materials, User warrants (i) that said materials are not subject to any copyright, trademark, or any other intellectual property protections or (ii) that User owns the intellectual property rights relating to the design materials or is otherwise licensed, authorized or permitted by the owner of said intellectual property rights to use said design materials for User’s intended purposes. In the event that any design materials submitted by User violate the intellectual property rights or other proprietary rights of any third party, User hereby agrees to indemnify and hold harmless the Administrators from any and all liability, claims, suits, demands, causes of action (and the cost and expense thereof), and damages arising from any infringement of the intellectual property rights or proprietary rights of another.
III. Payment Policy
The following forms of payment are accepted: (a) credit card (b) debit card (c) mail-in check. All payments transmitted electronically are securely tendered through Stripe, Inc. and are subject to their applicable terms and conditions, located at www.stripe.com/legal .
IV. Order Processing and Out of Stock Issues
There is a minimum of 144 pieces per Signature Series design.
Users can expect a turnaround time of 7-14 business days from successful receipt of a deposit to the completion of a proof. Should extra processing time be necessary, or should there be any issues related to an order, Administrators will notify Users via a method of contact provided during account registration. Additional charges may apply for rush orders.
Although Administrators regularly track and update item stock levels, Kahne Screen Print, LLC cannot guarantee the availability of all items after an order is placed. Should there be an out-of-stock issue, Administrators will notify Users via a method contact provided during registration and propose potential replacement item(s). Neither Kahne Screen Print, LLC nor the Administrators are responsible for delays or cost overruns resulting from out-of-stock or discontinued items.
V. Order Changes
Changes made to an order after payment has been received is subject to a fee of $200 in addition to any costs that may be incurred as a consequence of the order change. Administrators are not to be held liable for any delays due to an order change.
VI. Pricing
Kahne Screen Print, LLC may change item pricing at any time and without prior notice.
VII. Shipping Policy
Shipping is not included in pricing estimates unless specified. Shipping time is not included in turnaround time. Once the shipment is handed over to the carrier, we cannot guarantee timeliness or exact delivery dates. Neither Kahne Screen Print, LLC nor the Administrators are responsible for order delays caused by a shipping provider.
Users are encouraged to check the quantities and quality of the items immediately upon receipt. Neither Kahne Screen Print, LLC nor the Administrators be held accountable for defects or problems with your order unless contacted within 48 hours of delivery.
VIII. Print Quality and User Subjectivity
Kahne Screen Print, LLC stands behind the quality of our screen printing and will reproduce your graphic onto the item(s) selected with a high level of accuracy, quality, and consistency. The satisfaction of the end user with the final printed product is subjective. However, the aesthetic appeal of any design is affected by numerous factors, including but not limited to the printing method, design quality, and materials. Kahne Screen Print, LLC will use its best efforts to reproduce designs, but is not responsible for quality issues resulting from design quality or material issues. Digital artist rendered mockups can be provided at no cost for end user review and Users are encouraged to use their due diligence. Kahne Screen Print, LLC produces each order under standard operating procedures, quality controls, and guidelines to ensure a quality finished product and is not responsible for end user subjectivity.
IX. Spoilage Disclaimer
Neither Kahne Screen Print, LLC nor the Administrators are responsible for under-runs or spoilage less than or equal to 3% of orders. Furthermore, Administrators are not responsible for any minor irregularities related to shape, size, quality, or construction of materials.
X. Manufacturer Defects
Neither Kahne Screen Print, LLC nor the Administrators are responsible for mistakes or defects on behalf of the manufacturer or distributor including but not limited to: mislabeled sizes, inconsistent coloring, dye lots, manufacturer garment defects, etc. All items will be counted in bulk (dozens, or however they are packaged) as received from the manufacturer, as each item cannot be inspected or counted individually. Manufacturer and distributor defects or mis-shipments may delay production until all items are received. It is highly recommended to order more items than needed for each size or category.
XI. Returns and Exchanges Policy
Returns are only accepted if item is defective or shipped incorrectly. Returns must be authorized in advance by a Kahne Screen Print customer service representative. Returns must be received by Kahne Screen Print within 14 days from receiving the order. Invoice from order must be included with return. Returns sent back without invoice or proof of purchase will be returned to the customer. Returns are not accepted on items that have been worn, washed, or improperly cared for. Shipping and handling charges will not be credited on returns.
Items that are the wrong size or color may be exchanged. Only in-stock items may be exchanged. If required size is not in-stock, the item may be returned and refunded. Special order items may not be exchanged. Exchanges must be authorized in advance by a Kahne Screen Print customer service representative. Exchanges must be received by Kahne Screen Print within 14 days from receiving the order. Exchanges are not accepted on items that have been worn, washed, or improperly cared for. Shipping and handling charges will not be credited on exchanges.

XII. Order Cancellation Policy
Users may cancel orders that have not yet entered the art design process. No cancellations will be permitted after production or material alterations (printing, tag removal, etc.) have begun on an order. Users a subject to a $50 fee in addition to any fees incurred to cover services that have already been tendered.
An order may be canceled by contacting Kahne Screen Print via phone or email.
XIII. Intellectual Policy Claims
Claims of infringement of patent, trademark, copyright, trade secrets, or other forms of intellectual property rights may be filed for notice with the following agent:

XIV. Indemnity Clause
User hereby agrees to DEFEND, INDEMNIFY AND HOLD HARMLESS, to the fullest extent permitted by law, the Administrators from losses, liabilities, obligations, claims, damages, settlements, injunctions, suits, actions, proceedings, demands, charges, fines, penalties, costs and expenses of every kind and nature, including reasonable fees, expenses and disbursements of attorneys, accountants and other professionals imposed upon, asserted against or incurred by any Administrator in connection with, arising out of or relating to any content submitted, posted, transmitted or otherwise made available by User through the Service or User’s use of or connection with the Service, violation of this Agreement, or violation of any rights of another.
XV. Waiver and Release
To the maximum extent permitted by applicable law, Users hereby release, and waive all claims against Administrators and their employees and agents from any and all actions, causes of action, claims, suits, debts, dues, sums of money, bonds, bills, balances, losses, costs, expenses, damages, covenants, agreements, commitments, undertakings, promises, liabilities, obligations, lawsuits, judgments, orders and demands whatsoever, in law, at equity or otherwise, of whatever kind or nature, whether known or unknown, suspected or unsuspected, asserted, accrued, unaccrued, actual, contingent, or otherwise, direct or indirect and whether or not concealed or hidden arising out of, on account of or relating to or in any way connected with use of the Service.
XVI. Account Termination
Administrators reserve the right to immediately terminate your account without prior notice due to, but not limited to, the following reasons: (i) violation(s) of this Agreement, (ii) publishing material in violation of proprietary rights, (iii) engagement in fraudulent or illegal activities, or (iv) other objectional grounds. Termination of your account entails (a) removal of access to all offerings within the Service, (b) deletion of your password and all related information, files and content related to your account, and (c) prohibiting further use of the Service.
Terminations shall be made in Administrators’ sole discretion and Administrators’ shall not be liable to you are any third party for any termination of your account or access to the Service.
Privacy Policy

This policy discloses the privacy practices for Kahne Screen Print, LLC and its parents, subsidiaries, owners, employees, agents, representatives, and vendors (hereinafter referred to as the “Administrators”) of www.kahnescreenprint.com (hereinafter referred to as the “Service”). By using the Service, you (hereinafter the “User” or “Users”) agree to the terms and conditions concerning the standard of use relating to privacy outlined herein (hereinafter the “Policy”).
I. Information Collection, Sharing, and Tracking Mechanisms
Administrators only have access to information that is voluntarily provided by Users of the Service. This information is used to fulfill your order request and may be shared with a third party only when it is necessary to fulfill your request.
Administrators will not sell or rent Users information to a third party without permission. Unless Users opt-out (see section IV of the Policy), we may use Users information to provide them with information we believe you need to know or may find useful. Reasons for using your information may include but are not limited to: (i) updating you with news about our services and products, (ii) relaying information and updates relating to an order, (iii) to respond to requests or inquiries, (iv) personalize your user experience while using the Service, and (v) any other reasonable grounds determinable by the Administrators in order make improvements to the Service and better serve Users.
The Service may use tracking mechanisms to collect information about the User, including but not limited to Cookies and web beacons (hereinafter collectively referred to as “Technologies”). Use of such Technologies enables the Service to provide an individualized experience by: (i) ensuring user preferences, such as language or login information, is saved after the session ends (ii) ensuring items placed in the checkout cart remain saved after the session ends, (iii) user authentication, and (iv) other functionality to improve the User experience. II. Security
Sensitive information uploaded to the Service is protected both online and offline.
The presence of online security measures can be verified by ensuring that “https” precedes the website address (https://www.kahnescreenprint.com), which confirms that SSL and/or other forms of encryption are actively protecting your information as you utilize the Service.
Only authorized personnel, whose duties require them to access personally identifiable information (customer service, billing, etc.), are permitted to access personally identifiable information. This information, which may be retained in company computers/severs, is stored in a secure environment.
III. Data Retention Policy
Personal Information will be retained for as long as the User’s account remains active, and for an indefinite period afterwards.
Neither the Administrators nor the Service are to be held liable for disclosure of your data as a consequence of errors or unauthorized use and/or access by third parties.
IV. How to Unsubscribe and De-activate An Account
One may opt out of any future communication from the Service by contacting Kahne Screen Print by phone or email or opting out of mailing lists at the bottom of promotional emails.
V. Policy Amendments
We reserve the right to modify, alter, or update the terms and conditions of this policy at any time, without prior notice. Such modifications become effective immediately upon being uploaded to the Service. If you do not agree with the terms and conditions outlined in this Privacy Policy, immediately cease all usage of the Service.
